Breast Implant LitigationWhat is the name of your state? My sister had McGhan breast implants about 9 years ago. One leaked and deflated a couple of months ago. The company has offered to replace it and to pay a little towards the surgery but the balance will be her out-of-pocket. That doesn't seem fair. Any suggestions? Many Thanks. |

APOLOGIESI intentionally did not give a state as I assume if there is recourse it would be filed in federal court. My sister is in Missouri. |

My response: There are both Federal and State lawsuits against Dow-Corning, and a few others, in most every State of the Union. And I agree, it isn't fair. Have your sister seek a personal injury attorney in Missouri - - and preferably one that has experience in breast implant litigation. She can narrow her search by having her call the Missouri State Bar Association for a referral to an attorney or two in her area. Good luck to her. IAAL |

Breast ImplantsAre you aware of a mandatory federal class action against McGhan (evidently now Inamed)? That's what I'm gathering from what I've found on the web. And, it appears when that resolved, all future claims were barred. Make sense? She's talked to several attorneys in Missouri. None seem to think the damages are worth pursuing. She doesn't want to get rich off the thing --- just enough to cover her medical and, if necessary, attorney's fees. Thanks again. |
