I broke my tooth eating chips. Emailed the manufacture and asked what I needed to do to file a claim. They asked me to have a dentist write up a small summary and mail it to them. I did and they gave it to a local claims adjuster who sent me a form that will waive all my rights for the cost of the crown procedure that needs to be done. I did not sign the waiver and asked the claims adjuster to compensate me more than what they offered to cover any future problems with my tooth and for pain and suffering. They told me that what I bit into was inherent to the product "like biting into a hamburger and biting into a small peice of bone" I don't think it is unreasonable for me not to expect to bite into something as hard as a rock in a bag of chips and if it is inherent to the product shouldn't the bag warn of this problem? Anyway I live in California and I think the claims adjuster is calling my bluff any help in the right direction will be greatly appreciated. I also have the bag and the hard crusty rock like artifact. Also the claims adjuster said they are not admitting any liabilty. Then why am I signing a waiver. A rock is both foreign and unnatural to the product. So... stand firm. Bill them for everything you can get your hands on -- medical, pain and suffering. To figure out your pain and suffering on this (a lawyer won't touch this, money isn't enough), do one of two things:

1) contact a lawyer and see if they would give you a free consultation
2) go to your local law library, act nice nice to librarian and have them help you look it up. -- case history, etc.

I did not actually bite into a "rock" but a piece of product ie. chip like substance that was described to me by the manufacture as a "overly deep fried piece of patato". They knew exactly what I bit into... Thanx for the repy.

Take what they are offering as you will not get $$$ for future problems, pain and suffering etc.
