What is the name of your state?

I'm in new york and i purchased a half gallon of ice cream and found what may be a large spyder in it. Initial phone consultation with a local lawyer suggest i may not be able to sue but what should I accept if they offer to settle. What is the name of your state?

If they give you $1 or more, take the money and run.

You have no case.

What exactly are you going to sue for? What were your damages?

I am just shaking my head here. Were you mad that there were not more in there than one large spider. What was the flavor?

Vanilla Ice Cream

I would prefer no spyders thank you! Would this be my gripe?

due to defendant's failure to exercise due care, plaintiff may state a negligence cause of action. [Mexicali Rose v. Super.Ct. (Clark), supra, 1 Cal.4th at 630-631, 633-634, 4 Cal.Rptr.2d at 154, 156-157 (overruling Mix v. Ingersoll Candy Co.
