Case or not RE: medical malpractice?Alabama - Just a quick question, because I've seen some very good advice here and am hoping to get at least an idea of whether this will go somewhere or not. Long story short - my grandmother (age 71) had surgery today to repair several broken bones as well as ligaments in her wrist. She fell approximately two months ago, was told that the x-rays showed a broken bone in her wrist, and was put into several successive casts. She kept telling her doctor that she was in tremendous pain, but he dismissed it, telling my mother she was complaining "because she's old." Turns out that he apparently missed the other two broken bones and nearly severed ligaments. She's doing well at the moment, but may never fully recover strength in that arm - is there any case in this? As a side note - she has leukemia as well, so they were reticent to do surgery to start with. Thanks, guys. |

| No. You could try Small Claims and open yourself to a counter-suit for a frivolous claim. Last edited by vrzirn; 02-20-2002 at 12:08 AM. |

71 yr old fx arm71 yr old with mis diagnosised fx arm it would appear to me that if the 71 y/o patient was complaini8ng of pain frequently and the MD failed to diagnosezs a fracture and a torn liagament ...that that does fall under negligence .... |

| For whatever it's worth, I am in total agreement with Jupitere7. If a doctor isn't willing to listen to his patients, he shouldn't be a doctor! |
