choking 3 year old


vermont....feeding my 3 year old some cereal. the ones that look like little o's. He began choking, then turning blue. Found he had a peice of plastic in his throat. When I checked his bowl of cereal I noticed small peices of plastic. I checked the inside of box, that is where they were. I took him to hospital and his trachea is swollen and he is hoarse still from the choking. What should I do legally about this??

You can contact the 800 number on the package and make a complaint and they will investigate whether or not the plastic came form the box or was added later. Perhaps you will get some coupons. Don't throw away the plastic or the box.

You seem to have started a number of threads looking to sue people and you may be seen as litigious. You also have ongoing custody issues involving your son's care.

Yes. I have had a rough few years. Between a jerk of an ex, and issues of harassment from men at work, and now this, it makes you wonder what will happen next. I only ever have had one lawsuit, and that is the harassment one. I have been getting as much knowledge of court and legal proceedings, reading up on statutes, and doing case study on my own now for 4 years. I like this forum, even with the griddy jokes and insults..lol. I find the people here informative, knowledgable, and have good common sense. I have become somewhat of an advocate for friends and family members also, and use this forum with questions of their circumstances when needed. Thanks for your help. I will probably just write the company a letter, tell them what happened, and alert them to a packaging problem. Thank God my little one was ok, then it would be a different story. Anyways, thanks for your response. Faith

We had a similar post last year where OP found a screw in the product, it turns out a neighbor boy placed it in the pot when she wasn't looking, she updated the company who was investigating her claim and she still got coupons for her honesty.
