| civil rights of prisoner with broken leg. My brother was arrested in Missouri, November 2001. At the time of arrest he was suffering with an unhealed broken leg. He broke his leg in January 2001. After 1 surgery and several medical opinions he has been told that another surgery is the only way to repair it. The Camdenton jail will not allow him his crutches or transportation to a physical therapist after the very badly needed surgery occurs. His surgery was set for February 28th, 2002. The surgeon that is willing to repair his leg isn't getting any cooperation from the jail to be able to keep the set surgery date. He was arrested for a DUI and arrained with Time served and court costs. He is now being held for back child support. The child support is due to his inability to work since January 2001. He cannot afford legal aide. His only asset is a vehicle that isn't in service currently. He has been appointed public defense that tells him to plead guilty. His family feels his health is being neglected. He likely has grounds for a malpractice suite or could be eligible for Social Security benefits if the jail would allow him something other than a very expensive collect phone call. How can he pay child support in jail with a broken leg? What should he do? |
