Question

Defective product from Kelloggs. Possible legal action???

Ok, let's see if I can get all of this out without droning on. This happened to me about a month ago. I am in the Navy onboard the USS Enterprise. I had missed lunch and stopped to grab a Kellogg's® Nutri-Grain® Bar to snack on. In the middle of eating it, I came across what I thought was just a hard spot in the bar. But, after a minute of chewing and realizing that it wasn't dissolving, I immediately removed it from my mouth to find out what it was. It was a camel colored piece of paper. It resembled a hospital bandage. Within minutes of eating this bar, I became very ill and went to the doctor onboard the ship to find out what was wrong. The doctors looked over the package, and decided to keep me there under supervision "just in case". To make a long story short, I wrote a formal letter of complaint to Kelloggs explaining what happened as well as stating that if it had been my 3 year old son eating it, he probably would have choked and possibly died. Their response? $10 in free Kelloggs coupons! I called them directly and spoke with a supervisor and explained to him how upset I was about the whole ordeal and how I thought that $10 in coupons should not be used on someone who expressed sincere concern for their child as well as many other consumers out there. Not to mention the time I lost from work. They immediately mailed out a letter saying that they would provide monetary compensation, all I would have to do is list what I wanted. I sought a counsel on this matter, and he told me to sue. I still have all of the original packaging as well as the items in question. I know I would have to get the items tested first to find out what they were (Kelloggs wants me to send it to them), but I'm not sure about all of this. I want to pursue a case, but I'm not sure if I have one. Any guidance or suggestions on what should be done, or an amount of money I should tell them I want (even though I don't think I'll ever see it) would be greatly appreciated. And maybe I can find a lawyer out there who would pick up the case... who knows. Thanks!

You're suing for what? An hour of your time in the infirmary? No attorney will take a case that thin.

Expressing "sincere concern" does not qualify you for compensation. Nor does your speculation of what would've happened to a 3-yr-old who did not actually eat the bar.

Sorry bud.

I second that statement, and say they were generous to give you 10.00 in coupons. You had no real damage. You can't sue for what might have beens. I might have gotten a bar that had something in it too, but I didn't, so that doesn't mean I can sue.

yeah, i agree with shortbus and djohnson. you really don't have a case. but if this case still bothers you, then ask for advice from a lawyer just to clear things out.
