Question

Do I have a case?

I don't know much about this but am wondering if i have a case. I live in PA. In aug. i had a CAT scan for a sinus problem. The table raises about 4 to 4 1/2 feet off of the floor for the scan. After the first set of pictures they had the table slide out of the tube and asked me to flip over. I didn't realize how high off of the ground i was and put my foot down to flip over and ended up falling off of the CAT scan table and flew across the room. the nurse asked if i was ok and i didn't feel anything wrong at the time and i said i was fine. about 2 months later i had to go in for back surgery for a severely ruptured disk L4-L5. The doctor asked me how it happened and said i didn't know. He said it could have been hurt sometime earlier but through my activities gotten this bad. I didn't think of the fall off the table until later. I am now going in for my second back surgery which could include a fusion because of the severity, and have another possible herniated disk in my neck. This fall off of the CAT scan table is the only "accident" i have had. I am a very active 30 year old and I really believe this fall is the only thing that is causing my back to fall apart all of the sudden. However, while going through all of my doctor appts. I told them I didn't know how this happened, now it seems rather obvious to me. Would it be appropriate to talk to a lawyer about this? Thanks for any info.!!!!

There is a possibility of a case, but you would have some major hurdles to clear.

1) 6 months have passed since your fall. It would be hard to prove that this damage was a result of last August's test.
2) You admitted that you told your current treating physician that you didn't know what could have caused your current pain. That record would very probably be brought in.

Contact a local attorney and see about getting a free (or low cost) introductory meeting.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

In addition, since you told the nurse you were all right, it is unlikely that there would be an "incident report" on record to support your claim.
