Doctor operates without seeing X-Rays....


Last year, I was diagnosed with a herniated disk in my neck which required surgery. The doctor I was seeing took X-rays and discovered that a fusion of 2 disks were required to alleviate the pain I was having. Unfortunately, the doctor was not in my insurance plan so he referred me to another doctor to perform the operation. The doctor performed the operation but but didn't view the X-Rays to see that 2 disks had to be fused so the pain never went away. Just recently, the pain in my arm kept getting worse. My job recently changed insurance plans so I could return to the doctor who originally diagnosed my problem and took X-rays. It was then discovered that the doctor who performed the surgery only fused 1 of the disks and now the other disk was causing the pain. So now it looks as though another operation is needed to fixed the bad disk. Would this be a case for malpractice or something? You would think that something could be done about this since this could have been avoided. Thanks.

Well, this all depends on who had the duty to tell the new doctor to fuse 2 disks, not one. It depends on if the new doctor did anything that would be considered malpractice.
