Question

Dr. gave vaccine against my consent


What is the name of your state? Pennsylvania
My one year old daughter was "accidently" given the Prevnar vaccine against my wishes, and numerous signed refusal forms. I had signed the form in the past that I did not want this vaccine given to her. On her one year check up visit on April 18th, the Dr informed me what shots were given and when he said the Prevnar was given to her I told him I did not want it. His reply, "it slipped in". I initialed her chart that it was given. Since then she has been sick, has had two ear infections with two different antibiotics. I took her to an ENT/Allergist Dr and he said she also has a pneumacocal (sp?) virus and to watch her for a few days as it may, but would be rare, develop into meningitis. Prevnar is "suppose" to protect against ear infections and meningitis - the two things that are present only AFTER this was given to her against my wishes (and previuosly signed documents).
Is there a case since I had initialed the form that it was given to her, after the fact?

If you could prove that their was a direct relation between the rejected vaccine and the ear infections, it could be possible but, it would be very unlikely that any action you could take would be worth the cost and ordeal of bringing an action. Especially absent any significant 'damage' or claim.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

You don't say when you took your child to the ENT man who said she had a pneumococcal Virus (?) How did he know she had this virus? What has happened since? You will have a tough time with this case because so far you have not given any damages (injuries worth money), I think you'd better just take care of your child and forget the lawsuit.

This vaccine has proven to be ineffective for preventing anything and has been criticized for being administered solely to obtain $242 per injection for the manufacturer. The vaccine has been proven to reduce the effectiveness of other vaccines such as pertussis and IPV and possibly two more, MMR and Varicella. There are no longterm analysis or studies available as none have been done. One researcher discovered a 'casual' finding of the vaccine's causing diabetes. (Dr. Mercola's report)

This mother has every reason to be concerned but should not over-react and start seeing problems where none exist. What does need to be monitored is whether or not the PrevNar vaccine has weakened or nullified the effectiveness of other vaccines the child has received or will receive during the immunization period of childhood.

If the other vaccines have been, or will be, weakened or nullified, the child will have to receive those vaccines again, at a later time. When the appropriate time is, I don't know. I have no idea how long the effects of this vaccine will remain viable.

"(Pneumococcal Infections) are more likely to occur when predisposing conditions exist, including immunoglobulin deficiency, Hodgkin’s disease, congenital or acquired immunodeficiency (including HIV), nephrotic syndrome, some viral upper respiratory tract infections, splenic dysfunction, splenectomy and organ transplantation." (Dr. Mercola)

Unless this child has any of the above conditions, there was no indication to administer the vaccine to the child. As it was done without the mother's consent and in direct opposition to her written and spoken directives, I think consulting with an attorney would be advisable. If this child has to be re-immunized against any or all of the vaccines known to have reduced effectiveness, then there will be more costs and there will be more periods of time when the child has to endure the temporary illnesses that follow immunizations.

I'm not saying that the mother (on behalf of the child) will have any damages of significant amounts such as to warrant the expense of a medmal suit, but I am saying there are potentially some future medical needs and some future expenses that would not have occurred BUT FOR the 'slipping in' of the PrevNar vaccine.

I suggest that the mother insist that the physician's practice bear the cost of the vaccine, without any insurance payment or any payment from the parents. It was not just an unauthorized administration but is also an unauthorized billing charge.

Because this vaccine has proven to be essentially ineffective and is too recent to have longterm studies, I think it would be prudent for the mother to notify the CDC, Vaccine Adverse Events Reporting System, of the events and the results. Although this does not represent a significant adverse event, the information may be of significance to those who are monitoring this vaccine's usage and results; and, by sending the information to the VAERS, the information will find its way to the persons monitoring the vaccine.

The physician is required by law to have documented the day, month, and year of administration, vaccine name, manufacturer, lot number and expiration date, site and route of administration, and the name, adress, and title of the health care provider administering the vaccine. This information should be included in any correspondence (to the CDC or manufacturer) regarding the vaccine.

I would be angry too. I hope you found another doctor "whooops, it just slipped in there"...makes a huge statement and it isn't pretty.
