faulty repairs on vehicle

happened in colorado. my van was wrecked and i took it to an auto body repair shop and within 8 months the bondo started cracking and the clear coat started peeling. after numerous attempts to contact the repairman, two years later we made contact and he said that if we talk to him about the vehicle he would turn us into the insurance commissioner because he was simply the a third party in the repair of the vehicle. he said that if we returned to him as a customer he would have to take action against us. he said that because he never saw the check from the insurance company that he is out of it. he was paid for the repairs and now wont fix his damage. we remember his name being on the check but he denies it. is there anything that we can do to get the vehicle repaired at his cost and not ours or our insurance this time.
