federal malpractice help!


What is the name of your state? Texas. Can a person sue the government for injuries received while in the civil service , and on duty at the time of te accdent. I amnow on disability due to the incompetence of the u.s.army medical doctors at the time. i heard there was a law that one a not sue, if workers comp medical bills have been paid by the governement

I'll see if I can find a law or regulation, but I believe physicians are held to performing within acceptable standards regardless of whether or not the federal government paid for the medical bills; obviously you could not recoup medical bill payments or worker's comp payments as a result of malpractice (though the provider may be able to), but you may be able to recover for damages to you that were the direct result of a physician's negligence.

I am like you in that I have heard some 'law' about this, but I'm not sure what it was. I'll see what I can find out; again, I don't think it prevents a claim of malpractice against the physician, but possibly prevents a claim against the physician's employer (the military).
