house fire


What is the name of your state (only U.S. law)? new york
We had a house fire on 12/08.
Had many fire investigators on the scene and all came to the same conclusion that it was caused by a faulty Humidifier.
It was the unit itself that caught fire not the electrical outlet that it was plugged into.
My wife was awakened by the smoke detector (thank God) and she made it out of the house. All of the investigators said another minute or 2 and she wouldn't have got out.
She went to the hospital and was released after being treated for smoke inhalation.
The humidifier company is being sued by my insurance company.
My insurance company is covering my losses.
My question is do I have any grounds for a suit since my insurance company is covering my damages to the house ???
I'm mad as hell at this company which my insurance company informed me they have another suit pending in Arizonia against the same company for the same humidifier.

What do you want to sue for? You can't sue for anything your insurance company paid for since you assigned that right to them. Your wife may have a claim for her medical bills but if she was not seriously injured, she's not going to get much more then that. You can't sue for inconvenience or just because you're angry.

Yea I know I can't sue for my damages since my insurance is covering that.
I thought there might be something to due with her being pretty traumatized.
She's been having some serious nightmares and just about flips out when the alarm clock
goes off.
Thought maybe the company would have some kind of nusiance payoff .... just to get something.
