Large, dead worm in donut


What is the name of your state? Illinois

Last night I was about to take a bite of a donut, and I looked down and saw a big, cooked, worm stuck to the bottom, about the size of my finger. I was really disgusted and it made me throw up. I still have the donut, and I have pictures too. I called the store (it's a large chain) today and complained, they haven't gotten back to me yet. What are my options, legally, can I sue them? What should I do? Thank you for reading!

At most you could hope for medical bills to be paid, but as you didn't incur any the chances of monetary gain for you are minimal. You should notify your jurisdiction's health department.

Thank you enjay, I appreciate your help. I have a question about medical bills: can I ask them to pay for one in the future? See, I am recovering from an eating disorder, and still have alot of issues with food. This traumatized me last night, and caused me to relapse into some old behaviors. Woud it be appropriate to ask them to pay for a session with my therapist, $150, so I can work this out? What should I say to them on the phone when they call? Can I threaten them with a law suit if they are hesitant to pay? Or should I not ask them at all? Thanks again!

You didn't even eat the worm; you saw it.

Ever eaten fish? or chicken? or beef? If so, you probably ate a digested worm! Puke over that! (It makes me want to puke, too; so, I don't think about it.)

There is at least one attorney out there who will take your case, ie. the creep who is representing the person who ate half a worm in a baked potato. See if you can locate that attorney; perhaps being scared by a dead worm will be enough for you to qualify with that attorney.

Spend a dollar and buy a lottery ticket; you have a better chance of hitting the jackpot than winning anything from the donut shop.

Why didn't you just take the donut and worm back and state your complaint in person? I know the answer, you want to sue and make a lot of money; but, that is fantasy not reality.

Thank you for your input ellencee, I appreciate the time you took in responding. I'm not trying to make a ton of money off this. I just feel I have been wronged, and came here to see what my options are. I am only 18, know nearly nothing about the law, and am still quite upset over last night. The reason I didn't take the donut back last night is because it was 2am when I finished throwing up, and I was tired and didn't know what to do. I called them as soon as I got up this morning and complained.

If you are 18, now is the time to use the legal system and court system in a responsible manner. Bad things happen; gross things happen; life isn't fair; and, rarely do these events indicate the need for litigation.

And did you have the "worm" analyzed by an independant lab to verify that it is in fact a worm. A few months ago on this forum a woman claim she found a spider in her food. At my suggestion she had the "spider" analyzed. It was the head of a shrimp and her dinner consisted of shrimp.

As one that has dined on the various creatures available in nature, worms, although very nutricous. don't have much flavor. Mayfly grubs sauteed in olive oil with some garlic are very delicous.

Thank you again ellencee, you're right, gross things do happen, I guess I'll just have to get over it and stay away from fast food in the future. You're right that this doesn't need a lawsuit. I just wanted to know what my options were. Feel kinda dumb now. Anyway, thanks!

Racer72: I hope you're joking about eating that stuff! Yuck! No, I didn't have the worm analyzed or anything, but I'm pretty sure it's a worm, it has the ridges and pointed head part and everything. Really gross. It was raining yesterday, and there were worms all over the sidewalk, so one must have gotten carried in somehow.

There is no need for you feel dumb over this. That you do feel dumb shows you are capable of learning from life's experiences. That's a really good sign that you are on your way to full maturity.

The media leads the public astray with all of their hype about lawsuits while withholding from the public tidbits of information that completely change the legal viewpoint from what is presented to the public.

By the way, my husband says that fire-flys, or lightening bugs as we call them, taste like peanut butter.

JE85, you were fortunate not to have eaten the worm. My mother ate a cookie with a wire/staple type metal piece and had to go to the doctor. Moral of the story? junk food is BAD!

She took the cookie to the store where purchased, they submitted it to the manufacturer. As has been stated above, if you feel it is important to "report" this food manufacturer, contact the local health department. If you feel it is important to notify the manufacturer, take the product back to the store and fill out an incident report.

a refund of the purchase price is in order. perhaps something for your time/trouble/gas to return to the store. Make a reasonable request and youll likely get it.
