Question

Lawyer dropped caes 3 days before file date


What is the name of your state? Maryland

I hired a lawyer to handle a civil case involving a car accident. It was in back in December 2000.

3 days before the case had to be filed ( christmas eve )she called and said " I can't win so I am dropping your case" which I believe to be a lie. At which point I had her file the case in my name anyway. So the case was filed ,but she failed to inform me that the parties involved had to be informed within 30 days of the filing. I hired a new Lawyer after the 30 days and he told the case is DEAD because the 30 days had expired.

Now I have about 300,000 dollars in medical bills that I will never be able to pay off.

What are my options if any?
What can be done about a lawyer like this ?
what type of lawyer would take a case like this?

maybe u can start here - state bar association (maybe they have system for filing a complaint against attorney)

also, maybe consult attorney, whose "specialty" is suing other attorneys for malpractice, etc., about whether or not u have a claim to pursue.

If you believe your case is worth pursuing and you have $300,000 in medical costs, you can't just give up.

Look in the yellow pages for lawyers who handle legal malpractice. One of them should be able to help you. If, as you say, that first lawyer just dropped the case three days before the last date to file, without writing you a letter giving you a chance to file in pro per, then allowed you to file in pro per without instructions about serving the defendants within a time limit, and letting you fall into limbo, she is malpracticing. I hope she has a good malpractice insurance carrier. But go after her right away.

It is too late for you to find a lawyer to pick up the pieces.
