Legality of Cosmetic Teeth Whitening


What is the name of your state (only U.S. law)? Delaware

I would like to better understand the legal limitations of cosmetic teeth whitening in each state.

Recently, several states have started "cracking down" on teeth whitening kiosks in the malls.

The Tennessee Board of Dentistry recently ruled that any person who takes a dental impression of another person or who performs any phase of any operation related to teeth whitening will be deemed as engaging in the practice of dentistry. Those permitted to practice dentistry in the state of Tennessee are licensed dentists, and licensed dental hygienists and registered dental assistants who are under the direct supervision of a licensed dentist.

Those found to be practicing dentistry without a license will be subject to all legal action available to the State including but not limited to disciplinary action by the board. Disciplinary action for the unlicensed practice of dentistry can include monetary penalties of up to $1,000 per day, per violation.

In Oklahoma, workers of teeth whitening companies were found wearing white lab coats, providing medical release forms to customers and whitening gels with instructions on how to perform the procedure themselves.

At the time, The Oklahoma Board of Dentistry said the kiosks were not registered through them as licensed dental professionals, yet gave the impression they were practicing dentistry to the average person. The board asked the Attorney General to file injunctive relief against this particular company because they did appear to be misleading and that their employees were practicing the illegal practice of dentistry."


How do I determine which states have similar legislations?
Is the state board of dentistry the regulating body in each state or is it the state Attorney General?
