Question

First of all we are in Indiana. This is in regards to my father in law. Approximately a month ago he went to our local hospital with stomach pain and he was bleeding from his rectum. They did testing on him and determined he had a bleeding ulcer and was treated for that. Well I should also mention that he had been diagonsed with non hodkins lymphoma approximately a year and a half ago. Recently he has been in horrible pain, so he was taken to a larger hospital in our state, which has determined he never had a bleeding ulcer. His cancer had returned and that is what was causing him so much pain. What we are wondering is this malpractice on the part of the hospital in our town? They supposedly had done a test on him and said everything looked good, but the hosptial he is in now said basically said that is imposible, that he had the cancer then and they should have never treated him for a bleeding ulcer. Would appreciate any help someone could give us on this! Thank you so much!

Did he suffer any damage as a result of the misdiagnosis and treatment?

Would a reasonable doctor have mistaken it for an ulcer == ie. symptoms the same? Did they have his medical record to understand it may have been cancer?

You need to contact a medical malpractice attorney to determine if you have a case at all. [url]http://www.attorneypages.com.[/url] You might have a claim of battery for evasive procedures that were unnecessary.

Thank you for your response. Yes they knew his medical history, and they did have his medical charts. He had received chemo at this hospital. Also he had been in horrible pain, which could have been avoided had they treated him for the right problem a month ago when he went to the hospital. Also being this is cancer, the sooner they treat him the better the chances are he will go back into remission. By treating him for an ulcer, rather then cancer, they postponed his chemo treatments by a month or longer.
