I am from New Jersey. I had cervical surgury on levels c-6/c-7 in august of 98 to repair 2 ruptured disks. 2 weeks later a got a staf infection. 10 months later I had to have surgery for a herniated level c-5, which was repaired with a fusion. The next morning I told the drs that I felt exactly the same. The response was that I was healing. Over the next 9 months I had repeated visits with the orthopedic surgeon and the nuerosurgeon. They took x-rays, mri's, kept prescribing new pain medication, muscle relaxers, go for pain therapy, acupunture. All of which nothing worked. I was still in pain 24hrs a day. All along I was told that nothing was wrong and that there was nothing that could be done. Finally, in Feb of this year, I contacted a specialist in NYC. I went there with the same mri, he examed me, took x-rays, and when he viewed my mri, told me right away that the fusion from the last surgury did not take and was moving around. The only wat to correct it was to have another surgery and re-do it the correct way. I had surgery on May 15 of this year, and now feel great.The question is, are the previous doctors resposible for nor doing the 2nd surgery correctly? I specifically told them ( and I have a witness ), before the 2nd surgery, that do what ever you have to to make this right, because I don't want to go through this again.
Please advise as to what my legal standings are.

Dear Fred;

Depending on the laws in New Jersey, you may very well have a viable negligence suit. Visit a good medical malpractice attorney and pursue your concerns.
