I am from Pennsylvania. In 1994 I got pregnant with my third child and had a normal pregnancy with no complications until the week before delivery. I started leaking fluids and called my doctor who checked me and said it was just a prebirth showing and that I was progressing towards signs of labor. I went a whole week leaking fluids and my doctor never done an internal exam. My doctor went on vacation on Friday August 5th 1994 and my labor began Aug 6th 1994. Since my doctor was now on vacation another doctor took over his calls. I was admitted to the hospital in labor and was instructed at 7cm to start pushing due to my son not being down in the birth canal where he was supposed to be at this point. Several hours after that point and even after getting to full dialation I was not progressing. They did not wanna do a c-section even though my 2nd child was born that way. They used some sort of vaccum to deliver him and he is now 6 1/2 yrs old. He has had many problems since birth. Ear infections and he also developed seizures and is now labeled epileptic, and had eye surgery to repair his crossed eyes in 1996. Now he is attending kindergarten and has been labeled as mildly retarded and has learning difficulties. Since he was born in 1994 and we did not pursue this till now is it possible that his problems are due to the procedures during birth. Can we still sue since his medical problems seem to possibly point to the way he was born?
