Is the Malpractice? If not what is it?


What is the name of your state? Ohio
My father found out 4 months ago the he has type ii diabetes, reanal and liver failur. Since he has been but in the hospital we have had nothing but trouble. He has been mistreated buy the hospital and the doctors. His condition keeps getting worse. They have given him up to three years to live.
Every time we put him in the hospital for something they keep telling us we are neglecting him and they keep threatening us with putting him in a nursing home. When he is in the hospital he is treated badly. He has to take a diarectic and he goes to the bathroom about every fifteen minutes to half hour. When he rings for a nurse they take up to twenty minutes to check on him and buy the time they do he has already messed him self. Then they come in and yell at him for this.
He went to dialisys the other day we told them for a week that he was sick. They would not listen and he passed out. He could not be woken up. They took him to the ER and end up in the hospital again. He has been in the hospital six times.
There is a lot more I can cover if you need it. We are going nuts. They are more worried it seems to me to get us for negleting him that the hosptial and the doctors are doing it. We have talked to them about this but they ignore us. Let me know if there are any suggestion you can make. Anything will help. Let me know if you need for information. My aunt even has a tape of the hosptial admitting neglect.

Some of the information that you have left out is important. How old is your father. Is he on insulin? How long has he been on insulin? Exactly what are you accused of doing and by whom? Don't tell me a hospital, who? Nurse, doctor? Technician?
You have not listed any acts that might be malpractice. You have made it fairly clear that you think he is not getting the care he needs, but your question does not say exactly what you think should be done, and what is being done.
Please sit down and list your complaints one by one. Identify the people involved and tell us what they did.
If you can, tell us what neglect you are accused of. If you can show that you are giving him the care he needs at home, then do that.
Your father is suffering kidney and liver failure. That is something that is ominous and points to his early death. If you do see a lawyer, I suspect he will tell you that you can not sue anyone successfully because juries do not give patients who are dying much sympathy in a lawsuit. The jury will say, "He was going to die no matter what anybody did, and so why are they sueing?"
But if you are still concerned that the doctors are not giving him proper care, go to a lawyer and see what he says. Your complaint about the nurses not answering his call bell is a standard complaint against all hospitals every day, and probably will not attract much attention. Nurses do not answer call bells unless they happen to be standing by the door at the time, and then often they will return to the nurses' station to jot a note or two. Your general complaints are valid, but again, they may not point to a strong malpractice case.

Along with the above questions, I am wondering also if there is a reason you haven't changed hospitals? Is he retired military and has to go there? Can you get him transferred somewhere else? I agree that most of your complaints so far are standard to most places and have been heard a lot. I know it's a hard time for you and the situation isn't ideal but you have to focus on what you can do and not so much on what someone isn't doing. Good Luck.
