Malpractice in Mississippi


What is the name of your state? Mississippi

What is the staute of limitation for malpractice cases in Mississippi? Is there a timeframe for discovery versus filing? Pls elaborate. Thank-you.

What does that mean?

We are so sad to have to start a process with our minor son for care given by two doctors last August 2002-Feb 2003. They jointly took x-rays, and jointly made a bad decision that will affect him for this whole lifetime.

We have been sitting on this in order to decided what action to take i.e. letter versus suit.

"There is no statue of limitation in Mississippi"-does that mean that should we decide to take legal action we can do so without panicking about deadlines? There is no deadline in this state? Is that normal? Also, are there other consequences without statute in this state?

Let me suggest you look in the yellow pages, pick a med-mal attorney in your area, phone the office and ask if there is a med-mal statue of limitations in Mississippi.

There are numerous sites regarding med-mal situations within Mississippi and the scenarios are many. For example, if a county, city or state facility is involved, such as a hospital, the limitations are very short, could be 90 days.

I assume when you ask about the SOL you are not referring to criminal issues, which of course, there are many in which there is no SOL.

Please, call an attorney and put your mind to rest.

Sorry, mimi, HG was correct in stating their are no "statue" of limitations in Mississippi. You see, we, that is us rednecks in MS. ,have actually destroyed all our state "statues" erected to honor infamous attorneys, used the rubble to tie to their sorry butts, then find the closest bridge that crosses the Mississippi River**************well, you kinda get the picture.

Mimi, Mr. HG, because of the mis-spelling of "statutes", decided to play games with your post, with no consideration for the consequences.

HG, at times we enjoy your humor at some of the "roach in my coke" crap. However, this time I fail to see the humor in your reply.

I saw it and if you are related to the DaDrummer on aol then your brother would see it also.

As for his correctly pointing out the misspelling, what the hell do you think lawsuits are generated from?

One letter left out of a contract could mean the difference between winning and losing. And yes, it IS a big deal in the law to know how to spell.

Or do you think a Judge would correct your spelling if you were asking for a Da Nova hearing?

**A: yes brother, one letter could mean a big difference, brother. Like take out the r in brother and it would be bother. Take out the r in drummer and he would be dummer. Or dadummer. Bummer.
