We've been doing business with a Chinese manufacturer now for a while and we're now coming across various problems with their products. These problems are definitely in violation of international plumbing code and have several safety problems.

The manufacturer promised to fix all of these concerns as of this year and we specifically went through a list of issues with them. Each issue was gone through and we were advertised products quite different from what we received.

So now we have two problems on hand
1. Fraud
2. Unsafe products

After many photographs and discussions with the president, he has acknowledged that this was their fault and that his senior managers lied to us (in writing).

First thing we want to do is to stop other companies from making the same mistake by importing their goods. The company is fraudulent and bad to public safety. Their main market is in the Euro zone but they're now heavily advertising in North America as well for their other products. Secondly we'd like to recover some of our losses.

Any recommendations?

The FDA last month said it is blocking certain types of Chinese-processed seafood from entering the U.S. due to excessive bacteria in the seafood - this comes after the quality and safety of Chinese-made exports led to the recalls of contaminated pet foods, tainted wheat gluten, children's toys laced with harmful chemicals, mislabeled baby formulas, counterfeit toothpaste, toothpaste containing diethylene glycol, and defective tires, among other products.

China has reported that nearly one fifth of their food and consumer products investigated were found to be substandard or tainted, although the actual amount may be much higher.

You can report the potentially defective and hazardous products you have encountered to the U.S.Consumer Product Safety Commission. Suits against Chinese manufacturers, however, are difficult to bring and extremely expensive. Many companies have traveled to China to stop the illegal trafficking of counterfeit goods, for instance, only to return to the U.S. to find the trafficking was continuing unabated. Enforcement of U.S. laws in China has been a challenge.

The attorneys on this forum may offer you ways to recover your losses.
