my question involves an issue of medical negligence. a little over a week ago, i went to my PCP for a routine physical, & i was advised to fast the night before. after the dr. performed his exam, his nurse came to draw blood for the blood work/tests. immediately upon her removing the needle, i informed her that i was feeling dizzy & light-headed. she asked if i had ever passed out from giving blood & i replied, no, & commented i had this done before (once before in that office) and have never felt that way. she asked again if i was okay and i replied, "i think so." she then left the exam room to do whatever w/the the blood. during this whole time, i was sitting upright on the end of the exam table. the dizzyness quickly became worse, i remember taking a few deep breaths, and the next thing i know is that i'm being picked up off the floor by the nurse & dr. i passed out and hit the floor face first, shattering my glasses, & receiving several cuts to my left eye. blood was everywhere. i was rushed to the er & had to have numerous stitches. after the er, i went to an opthamologist to find out i had a corneal abrasion as well as a severly swollen & black eye. my glasses were also destroyed. i also had a cat scan which revealed a small fracture in the lower orbit of my eye.
my question is, what recourse do i have for this medical negligence? i feel it was the nurses responsibility to not only advise that i lay down, but she should have never left the room after i informed her i wasn't feeling right. i am, and will, incur more med. bills, my glasses must be replaced, & i have suffered through a great deal of pain and embarrassment. am i entitled to any pain and suffering in addition to my bills?
do i have valid case? what should i do next? i would greatly appreciate any advice and direction. |
