Medical Negligence?

One year ago I had spinal (neck) surgery. Ever since the surgery I have had severe pain in my right shoulder. Although I told the surgeon about it on follow-up, he said I shouldn't blame everything on the surgery. After the surgery I had large (about 3" diameter), black bruses on the front of both shoulders. I asked the surgeon about these, and he said they had me "taped down" during the surgery. This makes sense since they were operating on the back of my neck.

I have now been diagnosed with a torn rotator cuff and am in physical therapy and seeing a bone specialist. There seems no doubt the torn rotator cuff is from the surgery, which kept me face-down for four hours. Is this compensable?

if your injury is due to negligence and not something that either typically happens in surgery or you were not informed completely about prior to surgery, then you may have a case.
