medical question pertaining to malpractice/negligence


Arizona... Hi. I have been on disability for five months. At my three month visit, my physician stated he could no longer assist me with my illness.(anxiety/stress/panic/depression)... He stated he would refer me to a specialist. However, he failed to submit the proper referral, so I was not able to go to this "specialist". Would this be considered abandonment or negligence in my care by my physician since he stated he could no longer help me? I ended up finding another physician, but now my disability is denying my benefits due to this negligent treatment. Is a physician required, or is it common practice for a physician to notate phone calls placed to a physician and a physician to a patient regarding treatment/care or consultation? How about prescriptions or samples his office gave me as at the time I wasnt financially able to purchase these on my own. I failed to find these sample drugs notated in my medical records, which I thought would be neccessary. Would either of these be malpractice or negligence as well ? If this physician was to have returned me to work, but failed to fill out the proper fitness for duty paperwork enabling me to return to work, so I had no choice but to stay home, would this be negligence or malpractice due to his lack of care? and finally , one more question :0) , what comments would you have regarding a physician who charges you a co-pay and bills the insurance company, not for a doctor/patient visit, but to just fill out paperwork ie: fmla papers ect.. I asked him to please fill these out when he had a chance, and he stated he couldnt, he would have to have me come in with the papers and fill them out, but not do a patient exam or routine visit. He said this is how his practice works. I felt this was a type of insurance fraud, charging only to fill out papers. (every "receipt" I have ever received from his office are always blank, they would demand a signature and payment, but not notate for what reason that visit consists of, thus this paperwork/visit receipt could be filled out however the physician or office wanted)....(ie: my receipt is blank, his office notes states in for a routine visit, when in fact it was just to fill out a piece of paper with his signature)...... any suggestions or advice would be greatly appreciated...thank you!
