My little girl almost swallowed a metal spring in a Hamburger


What is the name of your state? Palm Beach Florida

Tonight my 13 year old son and 12 year old little girl had dinner at a very nice sports restaurant. She had started eating a large hamburger, when she felt something in her mouth and gasped and spit it out. It was a large spring type of material shaped like a (V) about 1.5inches long and black. It was very hard to bend and two of the managers came over and were very upset. They both agreed that this was out of the meat because it would have been seen in the kitchen. The manager is holding the piece in a secure bagged locked up safe till he talks to his supplier, I believe he said Chenney corp. We both agree that is must be a part from some machine in the meat plant. This could have been a very tragic night. I just cant believe this part was not found. The equipment had to have some problem after this piece broke off. You would think the factory would have checked for the location of their missing part before letting any products leave.
Its 4am, I haven't been able to sleep just thinking how lucky my little girl was. If she had swallowed this part there would have been nothing anyone could have done, it would have lodged in her throat. THANK GOD. SOMEONE SHOULD PAY FOR THIS LACK OF CONCERN! YES?

My response:

I'm glad your daughter is okay, and nothing worse happened as a result - - however, in response to your question, the answer is no. Perhaps, the restaurant will give you a free meal or not charge you for your current meal as a matter of "good will", but the fact remains, your daughter did not get hurt. No damages, no money. It's as simple as that.

And, I can hear you now, "You mean to tell me that my daughter would have had to chip her teeth, or choke and sustain damage to her throat, or something worse, before she could sue the restaurant and the meat supplier?"

And, sadly, the answer to that question is yes.

In the law, it works the same way as in sports - - "No harm, no foul." So, in order to obtain monetary damages, she would have needed to be harmed/damaged in some manner and to have sought medical/dental treatment for any such injuries.
