neck injury


About three weeks ago I noticed that a weld holding up the rear support of the ladder rack on my company owned service truck was partially broken. I pointed it out to my Supervisor. He wired it up for support and told me he'd have it repaired as soon as he could. Before he could make arraingments to get it fixed he was fired.
Move ahead in time: I arrive at my first job of the day, I slide my ladder back to remove it from the rack and both welds give way, the wire doesnt hold and the ladder conks me on the top of the head and causes an "acute cervical strain" according to the emergency room physician. (Nice clean clinical term....VERY painful.)
My question.....Who's liable? My company and/or the manufacturer of the ladder rack? Should I retain an attorney and litigate or just chalk it up to painful experience. I'm not a real agressive " I'm going to sue " kind of guy but given the pain involved in this injury I feel somebody should be accountable.

It seems as if there will be long term injury and pain. If so see a lawyer -- the employer is likely covered by Workers Comp, but if the products sold by manufacturer A was faulty, or it was improperly instaled by Firm B, a lawyer could sue them.
