New cell phone with porn movie!

What is the name of your state (only U.S. law)? FL. and SC. I was visiting my sister in FL., and as we are on an ATT Family plan (in her name) we went to RS to get an upgrade for my phone. We purchased what we we were told was a new phone only to find out that the phone has five hrs. talk time and pictures and a porn movie on it. Should I see an attorney or just exchange it?
I almost gave it to my niece as she said that phone was the one she liked.
I have returned home (SC.) and have this dirty phone that I have not used and am wondering what to do with it. We bought it thursday night, charged it,and found the movie Friday.What is the name of your state (only U.S. law)?

Or just do a hard reset on the phone to erase everything that's on there.
