NEW HERE~ malpractice or no ?

What is the name of your state? below is a letter i used in email~ please read and give your view of legal action or not an option!! if you take the time to read I THANK YOU~ im to a point with my daughters medical issues that i strongly feel, if the doc's that have been treating her( labeled ADD @ age 4 1/2, now she is 13 next mo.) would have cared enough to listen to me and look at the test that were done and not done~ she would have been on a different treatment all these yrs.i have done all that the doc's,schools, social services have offered with no improvement in our lives. just many hours, days, yrs spent and only symptoms getting worse. NOW we are at a point that we are losing the battle of life. there are many details that i wont get into now~
i will list a few and hope there is enough for you to understand what we have been thru and contact me. im looking to hold the medical and school system~ responsible for failing to provide accurate services for my daughter.
some examples ~ since early on in ADD lable the meds were not effective in working on the symptoms, and doc's only kept changing the meds.( she doubled her weight in 2yrs(@start weight about 40lbs, age 6 about 85) normal is to lose weight) kept going to counseling and med docs with my complaints of NO IMPROVMENT THINGS GETTING WORSE. they did nothing but change meds ( which didn't help any) and in counceling only talked about daily b.s.~ my daughter during the treatment at that time showed symptoms of many emotional and social concerns, yet no one help us thru ( they didn't really acknowledge any other issue than ADD till age 8)
she was tested by a NEUROPSYCHOLOGICAL EVALUATION, at age 8yr.10 mo.~many of the prior symptoms were backed up by this test. docs from that day forward still did not give the right(1 that worked) treatment! each medical person only went with origanal ADD label and not listening to me that what we have tried so far has not helped at all, ALL is getting worse!!! just 2 mos ago I FOUND OUT THAT THE EVALUATION WAS NOT READ ( says test report was in the wrong area of file~ did not see she had this testing) i believe that a treatment could have been given to help my daughter not make her worse. im to the point of putting her inpatient to stabalize her, for a complete workup and treatment of the now so in your face issues she has, feeling that the doc's up till now have missed treated her. she now has lables of ADD, EXTREAM ANGER , ODD, ANXEITY, DEPRESSION, MOOD DISORDER, EATING DISORDER, SOCIAL FAILURE.
she is a very bright girl who the systems have failed us to help her mental issues since mid age 4 AND now she (we) are so far lost and still what doc's here are doing ( and school ) are failing us. i have over the YRS of conditions getting worse in my daughter, come up with my own mental issues and physical( still unknown lable- first went to my doc back in 96ish for symtoms of burning im my body and extream fatigue ~ little physical effort~ ex.dishes, washing hair, carry out garbage ( single mom, medical issues, and yrs of mistreatment) can barly work and function outside of consitant monitoring of my daughter.
i'm sorry this is so long and hope you made it this far in the reading~ in this battle to help my daughter overcome her medical and behavior issues and am turning to legal assistance.( maybe that will wake up the system where i live and not treat other children and familys with such harmful carelessness) there are many more details that i wont go on with at this time, ALSO SCHOOL HAS NOT WORKED WITH MY DAUGHTER ( DOES HAVE AN IEP)~THANK YOU FOR YOU TIME~

Hi anigakagina. I'm sorry you're going through so much. Your post is quite confusing. You have many issues going on, and in fact too many, I think, to be able to deal effectively with this right now (and especially over a public forum where it's not face to face, person to person). Your situation is complex. I'm not trying to brush you off (I do feel your situation deserves someone's attention), but I think this situation and your problems would be better addressed if you call the Department of Social Services and ask them about mental health services and legal aid services that might be available to you and your daughter. I'm sorry I can't be of more assistance here, but I think it would be a waste of your valuable time if I tried to do anything other than refer to DSS.

What was this evaluation that you say was ignored?
Try, if you write in again to list your complaints carefully and briefly. Maybe if you list them as 1.xxx 2.xxxx and so on it may help you organize your thoughts. We would like to help.
If an examination by someone not previously involved in your daughter's care came up with another diagnosis (other than ADD which is a catchall), that would be important.
Please do try again when you can be calm. Or perhaps you have a friend who can help you pose your questions.

hello~ thank you above for replying. im sorry it took so long to respond, i did get to read your reply longago, but unable to get back here to respond. as usual my days are upside down, and don't know how to straighten them up. i have so many issues and thoughts that i cant seem to get them in order. lots of days i wish for a personal assistant type person to knock on my door and to guide me thru these messed up days. i battle not only with myself issues but also that of my daughters special needs, as i tried to explain above in posting. if anyone would like to listen and try and put bits and pieces together feel free to email me.
