Nintendo Wii Injury - Torn rotator cup


I have recently injured myself playing the Nintendo Wii. Somehow my mindset was affixed on the idea that I had to hit an object and having a sub-conscious absense of "swinging at air" I woke up the next morning unable to move my right arm. I saw a Physician and they sent me for an MRI which revealed 2 tears in my right shoulder rotator cup. One tear was torn clean through. Now I am very limited as to what I can do with this new injury. If I go after Nintendo what kind of compensation would I be looking at???

Just about zero.
You assume the risk when you play the Wii - it's labeled and there are warnings up the gazoo about it.

READ IT! There is no warning for first time users


The only warning that is given pertains to repetitive use and it states basically that if you are sore then you should stope, rest and play it again. The game lacks the number one action involved in all sports where you strike an object and there is a strike resistance that has been psycholigically learned throughout a persons whole lifetime. When you swing at a baseball you feel the strike and this is not pre-warned anywhere in the literature nor anyones WHAZOO!

So, let's approach this in a different scenario. If you go to a large theme park and are instructed to take a certain action on an object and that action permanently disables you then what kind of compensation might be expected......from a large corporate stand point.

There are multiple warnings about knowing your limits and not overdoing your play. If you were swinging your arms hard enough to tear a muscle, you were doing it wrong, for one thing, and you should have paid more attention to your body's signals, for another. Nintendo is not liable for YOU overusing your game.

If you seriously thought that it was going to feel like you were hitting a baseball when you swung your remote, then the help you need is psychological, not medical.

My right arm is done and I'm pissed


I just need everyone to understand as I am sitting here alternating my one hand around this freakin keyboard and I have had 3 turn downs on employment possibilities because I'm basically screwed here. I'm a single father of 2 kids whom I've been raising for the past 12 years and who rely on me for a life and I can't even get a freakin one arm dish washing job or anything. I mean not nothing folks. So, it's not about greed or anything it's about what I'm (including kids clothing, school, health, holidays, summertime's and anything else they have to go through cause I'm now screwed and can't work. Yes the doctors' report says, "Totally disabled due to intractable shoulder pain" whatever intractable means....not sure there. So for those who are thinking that they are hearing from a con please step into my shoes for a moment and explain how I'm suppose to live now. My monthly expenses are over $3,200.00 and Social Security will pay like $1,100.00

ANY SUGGESTIONS???????????

Wiis are cheap, only $250, and the game that he hurt himself on is the one that's included with the system.

What ever happened to responsibility for one's self? It sure is going down the toilet these days, especially with posts like these.

OP, you have absolutely no recourse against Nintendo as mentioned above. YOU chose to purchase the game system, YOU chose to play the game, and YOU chose to swing as though you were actually hitting a baseball (who does that, by the way?). Please provide support that Nintendo forced you do any of these things, and most people here will have a different answer for you.

Lord have mercy if you have the Wii Fit, I can only imagine what you will get yourself into next...
