my son has been ill for sometime, and has a feeding tube in his nose so i can feed him at home. he is 12 years old and has lost about 15 pounds, because he can't keep anything down, that is why the feeding tube. his doctor has told me that there are several other children with the same thing. one night my son threw-up very forcablly and the tube came out. i was afraid he had the ensure in his lungs and i was afraid to put the tube down him again. i took him to the e.r. at childrens in cincinnati.
my son's lungs were checked to make sure they were clear, and i asked them to put the tube back in and check the placement. the doctor sent in this male nurse who i was told sold the tubes for 10 years, and could do it quick as a bunny, and with little discomfort. i said ok. as he is getting everything ready, he starts questioning us about which one of us pulled the tube out. i told him to hold on, that my son nor i did no such thing. he said that they never come out on their own, no matter how hard you throw-up. then he asked my son if anyone could have given him something to make him sick on purpose and he looked at me. i said what the hell are you saying, that i am trying to poison my son. and he said that that would be the only way the tube would come out, and since he had been sick for so long that someone in the family was poisoning him. he said this in front of my son, and with no evidence. my son started crying and i ran out and got the doctor. i told her what was said and told the nurse to get away from my son. it has been proven i did nothing. this nurse called social services and reported i did try to kill my son. the hospital is trying to calm me down. no charges have been filed, but now my son is afraid to eat out,when he can, eat or drink anything. he crys alot and so do i, i am all he has and now this nurse has my son questioning if i ever wanted him and who would want him dead. he is in counceling at my demand.
i want to know if i have the right to sue the nurse for malpractice? and since the hospital has amitted he said it, can i go after them for emotionally hurting my son and slander? i studying in a field that this kind of rumor can cause me not to get a job, plus what is has done to my son. he thinks the state is going to take him away from me.
