Oil change bonanza - civil suit


What is the name of your state?

I am filing a civil suit against a chain oil service.

My story:
1. Took in my car for an oil change
2. waited for a long time
3. When completed, an attendant told me
" Oil pan was heli-coiled, the oil leaked. And he said
that it was like this when I brought the car in. The
previous oil change might have done the damage".
4. And he told me to sign the paperwork that said,
" I acknolwdge that the oil pan was heli coiled prior
to bringing the car to "THIS" oil change service. And
I must take the car to the dealer to replace the
oil pan ASAP".
5. I signed the paper - STUPID ME. I just wanted to get
out of there ASAP without thinking further.
6. I went back to the place where I had the previous oil change.
7. The PREVIOUS oil change service said that there was
no problem with the oil pan when they did the oil change.
The manager did the job on his own...

I FULLY BELIEVE THAT "THIS" oil change service did the damage.
The previous oil change service (i believe) has not done
the damage.

I have shelled more than $500 to replace the oil pan,
plus other expenses. Total civil lawsuit = $900 approx.

MY QUESTION!!!!!
a) How could I explain to the court that my signature should
not prevent me from the lawsuit?? It should be irrelevant to
the damage "THIS" oil company DID to my car.
b) any other advise you would recommend me do/say.



I trully appreciate all your help/suggestions/ideas.

I was thinking our writer's pros were written more like that of "Haiku" rather than the stylings of "e.e. cummings" - - only because his was short, like the following:

When I read the title to this post I just knew IAAL and Guru were going to have a field day with this one. I was not disappointed, but I dare say they let you off quite easy!!

OK, when you say "helicoil" I am presuming you are referring to the oil pan drain plug, although you could be referring to the bolts that actually attach the oil pan to the engine block, no matter.

The helicoil itself cannot cause damage. If the helicoil installation procedure failed then you could possibly have damage, BUT, and this is a BIG BUTT, as in Bertha, the failure would have been a loss of engine oil. If you have an oil pressure guage, or some people refer to them as idiot lights, you would (should) have noticed a drop in oil pressure which would (should) be a warning to seek service immediately.

How do you know how much damage has been done to your vehicle? Has the engine been torn down? If so, is there obvious signs that damage was caused by lack of lubrication (as in no oil)?
These are the practical questions this post raises to a shade tree mechanic. As for the legal stuff, I suggest you make a 180 degree attitude turn and try approaching IAAL and Guru again. But, you may have already burned those bridges. Most of the time you only get one chance with those cats.

i wouldnt be surprised if it was wally world. A few years back they put my oil filter on crooked and the oil was leaking fortunately it wasnt far from home. I removed, then put back on.....and now i just do my oil myself.

Nah, those boys give everyone two or three chances to screw up.

But Jet, not that's a different bird. That boy is downright mean. I've seen flesh haning from his teeth at times. And he doesn't even use Tobasco
