state of maine. i had an oil spill after the purchase of my home. my family was sleeping. my son has ashma. we began vomiting and getting headaches. called poision control. they said no side effects. called three times. found out later we did have simptoms. the oil spill was due to a ruptured oil line installed by the seller of house. the state had a hearing said the oil line was a code violation. do i have a case against the seller. we have not been to a doctor, not sure i want to know. is this a toxic tort? and do i have to prove the injury or just the fact the we were in the house and did have a spill?
