Question

july of 2000 (texas), i purchased a bottle of Heartburn medicine (90 qty). closed and untampered with.after 2 months of taking this medication.my husband pours out a couple on his hand and out pops a precription drug. i contacted the poison control. they gave me the name of the drug and was ahhed that this had happened. they said the drug had only been out for six months and side effects were undetermined.. but when i contacted the makers they had no idea what it was other than they wanted it back. so they sent me a postage paid envolope and a $20.00 check. well this past year my husband has had a rash come up under his arm and has had other minor problems. all unseen by a doctor. i am afraid if i cash the 20.00 check i am saying its okay for you to have put a presciption drug in my bottle. and that if my husband has any future problems well its "okay". what are my legal rights if any?

Dear giz;

As I understand it, you purchased the OTC heartburn med and you used it for approximately 2 months when your husband found the prescription medication, correct?

It would be difficult, if not impossible for you to prove that the medication was mistakenly put there by the manufacturer, opposed to someone in your home, or a visitor.

Cash the check and take your husband out to dinner.
