packing left in after childbirth for 2 weeks

Hello , My daughter had a baby two weeks ago .(natural birth) About 5 days ago she started to have an odor coming from her vagina and she called her doctor only to be told that it was not anything to be concerned about. She then called them this past wednesday and told the office that she needed to be seen because she was not feeling well and the odor was not going away. well the doc examined her and discovered that there was medical packing left inside her and when it was removed my daughter said it was black. Doc gave her two prescriptions of antibiotics and also is having her douche with a water/peroxide solution. Doc told her she had to put so much packing it (after the birth of her baby) that she had to "tie " two pieces together and the knot must have broken when the nurse was removing it and that is the reason it was left inside of her. Is this not malpractice?? I am concered that she could still get toxic shock. This material was in her for two full weeks. She did say she had the chills last week (infection??)and she did suffer from an uncomfortable "pulling" sensation in her vagina area. I am afraid there may be some permanent damage. Am I being to overly concerned?? thank you for any answers.... judy

The physician may be willing to absorb the cost of the appointment and examination and the antibiotics.

More likely than not, your daughter will recover without further problem.

Although technically the event does, more likely than not, qualify as negligence (malpractice), the damages are not significant. Without significant damages in an amount such as to warrant the filing of a legal medmal suit, the costs of such a lawsuit outweigh any potential award of damages.

You are fortunate to have a daughter who accepts responsibility for her health and advocates for her needs.

In any lawsuit for injuries "damages" means money.

And jack I do know that "damages" means money and if she were to suffer any permanent injury she would deserve $$$$
