Personal Sale: Snowblower

Item TORO 1028LE Snowblower

I purchased a USED (3 storms) snow blower. It was never expressed that it was "AS IS".
It is roughly 3 years old and was used 3 times when they first bought the house.

The blower was a house warming gift from the in laws.

I purchased the item in November 15th for $700. The machine was stored for 2-3 years and drained of gas.

I first used the blower on December 17th. I made passes f my 30ft driveway, on the 3rd pass it made a loud noise and shut off.

On inspection the block has a hole in it. After research it is likely the rod let go and cracked the motor casing.

The guy at first said "we can work something out" and to take it to a shop. I looked at it in the daylight and told hm it would need a new motor via email. Now he ignores calls and will not return messages.

What can I do? Small claims? Or am i SOL and out 700 bucks.

Sounds like you might be a little Short On Luck if no warranty was expressed, implied, or written. While the previous owner stated, "we can work something out", that would not obligate him.

Small claims, with his statement (so long as you can prove he said that), might be an avenue, but of course you know you would be alienating this friend/family member. You state that it was a housewarming gift, but you also say you purchased it.
