Something similar happened to my mom once with another food product.

She contacted the company and told them of the problem, they were very quick to apologize and send hundreds of dollars of coupons because she pursued it aggressively and mentioned a 'lawyer'. We didn't have a lawyer, but the food company didn't know!

I wouldn't send the plastic piece back to them without taking multiple photographs of it, and also the product packaging that it was in. Usually serial numbers printed on the wrappers/boxes have a code which tells the date the product was shipped and the 'batch' number. This might be useful if you do go to court.

You could always go to the dentist, get whatever work you need done, and then contact the company again explaining that the plastic damaged your tooth. Now you have evidence that it injured you because you have medical statements. This might be an easier way to win a lawsuit against them.

As always, consult a lawyer. Sorry about your tooth.

companies do not cower when someone mentions a lawyer, especially companies with their own in house lawyers! in fact companies love it when you have one because your lawyer is more able to understand that there is no case than you do. when someone tells me at my company they have a lawyer i say thank you, i can no longer speak with you but need the name and number of your lawyer and will need to speak with him or her.

the back peddling starts immediately almost 100% of the time!

Let me add that Wallyworld is NOT going to be scared by the suggestion of an attorney.

I don't have first hand knowledge of this, but someone I trust told me that Walmart is sued with such regularity that it became cost efficient to bring all the lawyers suing them for slip and falls into a room once a quarter.

They have a sort of "class" in settlement offers and evidence and the like, and then everyone files.

Saves a bunch of time.

No, threatening them with a lawyer isn't going to do much. Their lawyers can beat up your lawyers.
