Procedure for med malprctc suit involving 2 states (28 USC 1392??)I am researching information for my father. He currently lives in North Carolina and wants to sue an eye surgeon in NY. 5 years ago he had eye surgery in New York (his residence at the time). 1 yr ago he went to a specialist in Virginia (closest available to him) who indicated problems with the original surgery. Can someone please explain the procedure for filing, pro se, a medical malpractice &/or tort &/or personal injury claim thru the court system. I need to know what 28 USC 1392 has to do with torts and personal injury. Is there such a thing as a civil statute for filing personal injury? Is there such a thing as "Tort Act"? Thank you, SHiRL |

| No legal advice, just a thought - It seems that this forum, because of the nature of the medium, is more geared towards - and is very good at - specific answers to specific questions. Generalized questions such as "How do I file a lawsuit" seem to be beyond not the scope of the responders, but beyond the scope of this forum. If you have this many questions of this nature at this point in the process, you should probably retain a lawyer - if nothing else, take advantage of a free initial consultation to get an overall feel for the merits of your case.
