service negligence


What is the name of your state? Ohio

A car I own had an oil change at a JiffyLube store. The technician failed to tighten the new filter, so it came off some time during the 24 hours after the oil change. Oil flooded out, the car was disabled. Car was towed to a garage where the problem was diagnosed and repaired, however, a warning was given that there may be residual damage to the engine, and that this event has done damage to the extent that 100,000 more miles on the engine would have done. Am I correct in thinking that I should try to sue JiffyLube for damage to the vehicle, repairs, and inconvenience? What sorts of documentation will I be needing? What kind of attorney-specialist do I need? Am I nuts? Thank you.

*** Not unless you have LOTS of money to throw at this..... since your post makes no mention of 'real' damage... only possible future damages.

*** LOTS of expert testimony as to what happened and the long-term effects of their 'negligence'. And this doesn't even mention their defense.... "The filter was on tight when it left our shop. It is our position that the plaintiff or unknown persons 'tampered' with the filter after it left our shop".

"What kind of attorney-specialist do I need?"
*** Preferably one with experience litigating automobile damage issues.

"Am I nuts?"
*** Only if you pursue this one outside of the small claims courts.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

OK, you had your oil changed. Sometime within 24 hours your oil filter "came off". Oil flooded out. The car was disabled. Disabled means**************.....??

Did it "blow up?"**************....Did it "freeze up?"**************...Did it "run hot?"
How far was the vehicle driven within that 24 hours? What type vehicle do you own?

Unless you supply much more info regarding your problem we can't help.

I'm not trying to be rude but please be more specific.

And JetX raises very real concerns.

I know two different people who went to two different Jiffy Lubes for an oil change, had the oil drained out of the car and discovered too late that the new oil never went in. Just like the woman in the story Jetx directed us to. One had the engine seize while going around a rotary; the other had the engine seize while going through the Callahan Tunnel in Boston. At rush hour. Thanks for blocking airport traffic, Jiffy Lube!

I guess it depends on whose perspective you're looking at. For the person with the broken down car, the middle of the Callahan is definitely to be preferred. However, the gazillion or so people who are now stuck in the tunnel and on I-93 for several miles back because of the broken down car in the tunnel, many of whom may be missing flights because of it (gotta love Logan airport), I can assure you that they WISH that car were on I-10 in Nowhere, New Mexico.

BTW, is that any relation to No. Weare, NH?

cbg - you're wrong - I'd NEVER want to be stuck in the Callahan Tunnel - rush hour or ANY hour!

I guess it's a matter of personal preference. If I'm going to break down, I'd rather it be somewhere that there are other people around. Although I have to admit, the Callahan Tunnel wouldn't be my first choice.

How about the Teddy?

Luckily, I've never been through the Ted Wms. I try to stay away from those areas and with the construction still around - it's not one of my favorite spots even though I work around there. Can't wait for the traffic situation when the Democratic National Convention gets here this summer! Oh joy! NOT!

But, I guess you're right about breaking down near civilization rather than in the boonies. I agree!

I took the Ted Wms a couple of weeks ago when I had to pick my fiance up at Logan. It wasn't so bad. Of course, it was also 9:00 at night!

I'd love to stay completely away from the city during the convention this summer - except he's a political consultant and will have to be there the whole time!
