should i sue or forget?

My wife ordered me a roasted chicken breast with provolone and lettuces on wheat bread from the (omitted) at the elm grove shopping mall. she arrived home for dinner. After getting ¾ of the way through the first half I began to cough and gag. Any idea what it is like not being able to breathe? To my amazement I coughed up a piece of plastic that was in the sandwich. With what feels like a scratch in the back of my throat led me to more coughing and gagging till I vomited. This morning I am still coughing like there is something back there. I am 41 and have had a heart attack and open heart surgery. The throwing up caused pain in the middle of my chest which felt like heart attack. I had to take two nitro as prescribed to get the pain to subside. One nitro away from a trip to the E. well just got back from the doctor and he told me i have irritation and a scratch in the back of my throat. attorney?

You have a scratch in your throat and you are paranoid. This is not damage. You have no case.

tell the sandwich place and maybe they will give you a coupon for a free sandwich

call the manager of that store right now


tell them what, when you ordered and tell them what exactly happened to you.

if they give you something, great.

if they don't, you are recovering and will never eat there again and its over, live on.

now if you had to be taken to the emergency room....then you lawyer up.

but its just a scratch now. but you need to tell the manager immediately.

i once got some take out, ate it, puked all night and day long, when i finally could stand on my own 2 feet again, i drove straight to that place and told them, they refunded me.

i took it level 2, i reported it to the local health department so they could be randomly inspected.

i recovered, i never ate there again and i got my money back, its the best i could get.

as far as the health report, they failed!!! now they have to deal with the big boys and im a happier person.

What exactly would calling the manager right now attain? - it being a week after the original post?

(you do know that there must be tangible damages before OP's complaint would be considered, right?)

(and that's assuming he could actually prove his complaint...which would, in this case, be difficult at best - and when I say "difficult", I'm being really, really, really diplomatic)

Glad your uh.. "Level 2" report got you what you wanted.

If eating the plastic has caused you any illness or damage, you may sue but mind you the expenses you would spend in suing the restaurant may be higher than the amount of damages, if any, that may be awarded to you.
