son fell off a chair


What is the name of your state? florida
MY SON AND I WENT TO SONNYS TO EAT LUNCH BEFORE I HAD TO GO TO WORK. FIRST OF ALL, I ASKED FOR A HIGHCHAIR, AND RECEIVED ONE WITH A DIRTY TOP, WHICH DIDNT BOTHER ME, I JUST DIDNT LET HIM EAT OFF OF IT... HE JUST ATE OFF MY PLATE. BUT AS HE ATE, EVERYTHING WAS FALLING IN THE SEAT OF THE HIGHCHAIR, AND GOT ALL OVER HIS BOTTOM AND HE WAS STARTING TO TRY TO EAT IT... WHEN WE WERE DONE, RIGHT AS I WAS GETTING MY TO GO BOXES, AND GAVE THE WAITRESS OUR MONEY, I TOOK HIM OUT AND WIPED HIM OFF, AND PROCEEDED TO PUT MY FOOD IN THE BOXES. (HE WAS SITTING ON THE BOOTH NEXT TO ME, SO HE COULDNT EAT THE FOOD OFF THE HIGHCHAIR) I LEANED FOWARD, GRABBED MY BOX, AND MY TO GO DRINK, AND WITHIN THAT SPILT SECOND, THE CUSHIN ON THE BOOTH SLIPPED OFF AND MY SON FELL WITH IT, HITTING HIS HEAD ON THE BACK OF THE BOOTH BEHIND US. OUR WAITRESS, WHO WAS AT THE TABLE NEXT TO US, WIPING IT OFF, DIDNT EVEN COME OVER AS MY SON WAS SCREAMING IN MY ARMS. AFTER A LITTLE WHILE, A GUY CAME OVER AND OFFERED US A BAG OF ICE FOR HIS HEAD, WHICH HAD A BIG KNOT ALREADY ON IT. HE BROUGHT THE ICE, AND WE LEFT. NO ONE FILLED OUT AN ACCIDENT REPORT OR ANYTHING. IM A WAITRESS TOO, AND WHERE I WORK, IF SOMEONE STUBBS THEIR TOE, WE FILL OUT A REPORT, SO IT SEEMED STRANGE THAT NO ONE DID. I WENT HOME, AND WROTE TO THE MANAGER TO THE ONE WE WERE AT, AND NO REPLY... SO I WROTE TO THE CORPERATE OFFICE, AND STILL, A MONTH LATER, NO ONE HAS RESPONDED... I JUST WANTED SOMEONE TO LET ME KNOW THAT THEY KNEW THEY HAD A PROBLEM WITH THE BOOTHS AND THEY WERE GOING TO DO SOMETHING ABOUT IT, BUT IT SEEMS LIKE NO ONE CARES...WHAT SHOULD I DO? THERE SHOULD BE SOMETHING HOLDING THE CUSHENS ON THE CHAIRS, RIGHT? I KNOW IT WAS PARTCIALLY MY FAULT, FOR LETTING HIM SIT THERE FOR A SECOND, BUT IT WAS KIND OF THEIR FAULT TOO FOR HAVING THE SEATS LIKE THAT.... ANY INPUT WOULD BE APPRECIATED. THANKS.

P.S: Hold down Ctrl and press + when in your internet browser to increase the font size. Then if your blind we don_t have to be too.

My input:
Your kid fell down and got a bump on his head...it was your fault because you KNEW the cushions moved around.
You should be more diligent about preventing your child from fauling.

It is your fault for placing your child unattended on a cushion you already knew was loose.
You could have asked the server to clean the high chair.
You could have asked the server to place all the to-go containers in a bag or other container for you while you attended to your baby.
I suggest you call the corp headquarters and verbally express your concern re the loose cushions but don't ecpect anything other than perhaps a coupon or free meal.

In the future, PLEASE supervise your child more carefully in the future.

wow


i came on here to get advice, not everyone bashing it. my sons old enough to sit on a chair by himself, and the seat of the highchair wasnt dirty until after he ate... he got the crumbs in it. i didnt let him eat off the table either.. after i seen that the top of the highchair was dirty, i took it off and he ate what i handed him. (WITH CLEAN HANDS!!!) hows that for yelling... i didnt write to the corp. office in all caps... and im not expecting anything for free, not even a free meal!! i just wanted them to say "we have a problem if our cushens keep sliding off the benches, maybe we should fix it" and i wanted some advice of how i should approach them with it... not everyone telling me im a bad mom, or not to write in caps... im a very good mom, and none of you should say otherwise... hummm... maybe you all would have let you kids eat their crumbs off a highchair used by millions of other kids, but to me, a good mother would have taken their kids out and cleaned them off, just like i did. so, dont express your thoughts if youre going to be so damn rude about it!!! seriously, be constuctive**************(i tried editing to change it to lower case, but it wouldnt let me without re-writing it all...)

Not addressing "good" or "bad" mom - but I would like to say that this was foreseeable on your part. If your kid is not old enough to sit in a chair on his own, why did you sit him in a chair on his own?
Furthermore, I don't understand if you have a legal question or not...?

I wasn't referring to the SEAT of the highchair. I was referring to this statement that YOU made:

I happen to find that NASTY, especially when some soap, water, and a rag should have easily cleaned it off. In this first post, you didn't let him each off the top, but LATER you decided to mention that you took the top off, AFTER I said that you were nasty.

Write a letter, and ask for a response. If you don't get one, then don't visit that restaurant again, okay? That's your advice.

everything was falling in the seat, because i DIDNT have the top on... thats what i meant by, " i didnt let him eat off it it, he just ate off my plate." he sits in a regular chair at home... its just easier in a resturant to have him in a highchair... (so he doesnt get into everything, or try to get down.) anyone with kids would know what im talking about... my "legal" question was basically if they have an oblagation to change (or secure) their seats, or if i should just leave it alone.to give you a picture of the booths, the cushens are just sitting right on top of a wooden booth, with no backs on it, and they wax it or something, because it just slides all around... i was sitting on the booth with him, until i leaned forward to grab the boxes and stuff (which just took my butt off the booth for a second--when he fell), but i let im sit on it because i didnt think it would've slid back with me on it. im not trying to sue them, like most ppl on here, i just want to know if they should be more concerned than what they are... thats all... i just wanted some opinions from other ppl.

if youre not supposed to come on here to ask questions, until you understand what everyones saying, then whats the point of coming in here? and no, i havent... do they have an "legal" obligation to fix the problem or not? people come on here and talk to you like youre an idiot, and you dont expect them to defend themselves? you come on here, and tell your side of the story, and people twist it all around to make it your fault... thats not help... im just setting the story straight... i didnt let him eat off the top, so to be called nasty for something, because someone misunderstood you, isnt right. if you dont want ppl to keep coming back for answers, stop judging everyone, and tell the "legal" answer the first time you write.

From your own words the chair was provided to you with all safety devices affixed properly. It was you who altered the chair's design to where it was then rendered unsafe.

You have no case.
