Spa chair fire

What is the name of your state? New York

Fiance and I own a small spa which had a spa chair in a back room She is currently incorporating and has a client which is setting up insurance but it wasnt set up yet. Yesterday we recieved a phone stating that there was a fire and the fire investigators pointed it to wiring in the back of the spa chair. The fire extinguished its self by running out of air but most contents in the office are destroyed. From what it seems we will have to eat everything but my question is .. is there anything we can do against the manufacturer?

Will the fire marshal give you a report stating that the spa chair caused the fire due to its being defective?

The town fire marshall concluded it was confined to the chair and Im sure we can get the report. I also have a nys certified firemarshall who is going to go look at it. He works for a neighboring city. Now the insurance agency from the building im sure will probably also have an investigator for it.

My response:

How old is the chair?

IAAL is correct. If the chair is new you have an excellent case and need to immediately file a claim with the mfg. and the seller. A written report from the fire marshall is excellent evidence and should be attached to your claim. Document everything and keep the chair, if possilbe. If not take plenty of pictures. You will also need independent estimates of the damages.

The problem is much tougher if you bought it used but you may still have a good case. Expect to have to prove the chair has been used properly and not modified. Look through the paperwork and instructions that came with the chair.

IAAL is only partially correct..The chair is one part..The other is how it was electrically connected..Direct wire? or plugged to an outlet? Then you have to look at other areas to find what sparked the fire IE. Overload for the circuit, improper wiring (for direct wiring), surge of power (did you have a surge protector?)
