| I had a spinal fusion A year ago (in Florida) and after my year check up, my ortho found that two my screws are broken. No one has ever heard of this happening, and now i have to possibly go through another surgery. I was never told this was a possiblity, and all of my new doc's say that this is rare. Is it possible to get compensated for the next surgey under malpractice, or product liability? This would be my third surgery, I am non-smoker, fit, and only 23. email at nifferone@aol.com |

| I practice in St. Petersburg and Tampa, Florida. You can not sit on a medical malpractice claim. There is a short statute of limitations. When were you first made aware of the defect/malpractice? Based upon the facts presented it appears that you may have either a medical malpractice case against the surgeon and/or a product liability case. You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee. | I forgot to mention that any additional surgery, if it is directly attributable to the original malpractice and/or defective product, would be compensable. I am assuming that everything can be proved to be caused by the original negligence (med mal &/or product/liability). |
