is it too late


What is the name of your state? What is the name of your state? fl. my wife had surgery in 1995, in arizona, and she recently had an mri done and there was found 2 clamps left in her from this. is the statue of limitations up and if not what state does she have to file a suit in? is the hospital liable or the doctor or both?

Here’s a good medical malpractice site. This site also gives the statutes of limitations for all states and an explanation of determining when statutes of limitations begin and end.

Your wife needs a medical malpractice attorney. Consult one in your area ASAP.

Also, if you are contacted by private e-mail from anyone regarding your wife's case, be careful about revealing any details regarding her case.

Has she seen a specialist to see if those clamps pose a threat to her health? I'd be worried about her health more than anything right now.

No statute of limitations applies when foreign matter left by a previous surgeon is found.
You have a strong case of malpractice against both the hospital and the surgeon. So, see a lawyer and get started.
If any statute applies, it starts to run from the day your wife was told that clamps were found.
The only important thing now is to establish damages. That is up to your lawyer.

You asked what State do you file in. Arizona. If you are living in another State your lawyer may ask that the case be moved, but that probably will not work. The custom is to file in the defendant's State.
