toshiba laptop 3rd degree burn


What is the name of your state (only U.S. law)? MI

hi my wife was on her laptop one night and fell a sleep. woke at bout hour later and leg hurt and was burnt she said well when i looked at it i didnt beleive her cause it looked like a bruise not a burn and the pants she had on didnt burn at all. but one week later or so it started to open up then it got infected once so went to er got antibiotics . the longer time went by the bigger and deeper it got, now its like 2 months later and still open and not healing. called toshiba of course gave run around called some stupid lawyers around here and nothing any sugestions sorry about spelling and grammar i have pics but not sure how to post i look on site any help appreciated thanks

How is it Toshiba's fault that your wife fell asleep with her laptop on her lap? If the battery is one of those under recall, how come your wife didn't take care of that? The recalls have been out for 3 years or so.

Laptops are not actually meant for laps, nor to bed left on and unattended for long periods of time. This is why they are now called "notebook computers" in many places, since laptop is a misnomer. Laptops are giving to overheat when they are not place on smooth surfaces; on cloth or skin in particular you do run the risk of burning/fire because of a lack of air circulation, which allows the computer to overheat.

In particular, if your notebook had a RECALLED battery, this information is doubly true and it is your wife's responsibility as an owner to request a new battery in such a case.

This was all stated in pretty much every owner's manual, which I'm sure you read...

...By the way, they aren't *stupid* lawyers. They're lawyers who won't take your case because you have no case, and are just good enough to not take a bunch of money from you for a lawsuit you won't win.

Agree with Geekess. Your wife fell asleep which resulted in the computer burning her. That's her fault. Most instructions for laptops direct you to put the computer on a flat surface and warns that the computer may get hot if on for long periods of time. I know when I'm using mine on my lap I can't use it for very long because it gets warm after 30 minutes or so.

Buy her a laptop stand, call your doctor and let him/her know that the wound isn't healing, and call it a day. She has no one to blame but herself.

Oh yeah.. and to prove it.. in 5 seconds, I found this on the first random computer model I clicked, in the user's manual:

❖ Avoid prolonged physical contact with the underside of
the computer.
If the computer is used for long periods, its case can become
very warm. While the temperature may not feel too hot to the
touch, if you maintain physical contact with the computer for
a long time (if you rest the computer on your lap, for
example), your skin might suffer low-heat injury.

Good one Eryn. I knew there was some disclaimer in the manual somewhere. Every laptop has one... they'd be sued left and right if they didn't.

i asked if there was a recall and thay said not on that model. so what if she fell asleep how many people fal asleep with there laptop on what if your 15 year daughter feel asleep with on bed and it caught on fire. i asked for advice not insults but what ever i dont want a lot of mony just docter bills paid for cause she is going to have to have skin graphs

We're not insulting you, we're giving you the facts. The computer's manual warns that the bottom will get hot and should be kept on a hard flat surface. Your wife had it in her lap. Your wife fell asleep. That is her fault, not the computer's manufacturer.

They give you a manual for a reason. It warns you of potential dangers and how to avoid them. Your wife either didn't read it or didn't heed its advice, neither of which is the manufacturer's fault.

If my daughter's room caught on fire due to a laptop being on her bedspread for a few hours, unless there was some defect in the computer, it would be her fault (or mine, ultimately, since I'm responsible for her). It's pretty hard to argue it when the MANUAL says directly in it not to do so.

It's unfortunate that you will have high doctor bills, but hopefully next time you will follow directions. I hope your wife improves quickly.

what is prolonged period 5 10 20 minutes u tell me it wasnt on the skin it burnt through the jeans she had on with out burning the jeans.

First of all, weight has nothing to do with it. And not that it's any of your business but I'm 5'8" and 120lbs, and even my legs get hot when my laptop is sitting on my lap. It doesn't matter what kind of material you're covered with, you still get hot. Skin is more sensitive than denim in case you haven't noticed.

NOW you've given me reason to insult you (due to your rude post). Next time, READ the OWNERS MANUAL when you buy electronics. And if you are smart, you'll actually follow the DIRECTIONS. (okay, I'm not exactly being insulting... I'm just not good at it.)

You have not won the lottery, try again. Or actually, don't. It wastes our time.
