wrong body sent to funeralWhat is the name of your state? california the hospital that our baby died at transported the wrong baby to the funeral. this was not discovered until the day of the funeral when we had arrived. the baby had to be transported back out of town and our baby had to be brought back. this was an extremely humiliating experience not to mention all the trouble it caused. do i have a case to sue? |

| Probably not. You may have been distressed, but a lawyer will not accept your case for a simple reason. The case is not worth any money. Babies are not a cause for malpractice even in a case like yours. You do not say how the baby died or any of the circumstances surrounding its death. If the baby died as a result of poor medical care, you may have good reason for a malpractice lawsuit. But if everyone knew the baby would be born dead, and that it was a bad pregnancy, you would have no basis for a lawsuit. If you feel that something needs to b e done, then write a letter to the State Health Department, Bureau of Licensing and Certification in Sacramento and make a formal complaint, and send a copy to the hospital administrator. |

publicityIf the local newspapers in your area will print your letter to the editor, you could write one that states the facts of your case and that you are looking for an attorney to represent you to sue the hospital. You could also call the newspapers and ask to speak to a reporter, who could then write a story about the travesty. If the local T.V. newshows will air your story, that would be another way to publicize your desire to sue. |

| I am not understanding the part about the hospital's sending the wrong baby to the funeral. Does the poster mean the hospital sent the wrong baby to the funeral home and that the family did not go to the funeral home prior to the funeral? Or, in California, is it a service provided by hospitals to prepare the bodies of infants for burial?
