wrongful death


What is the name of your state? Illinois. How long do you have in Illinois to file a wrongful death suit????

Lawsuits are filed where it occurred, not where you live. You sue an Illinois MD in Illinois, regardless of where you live unless some circumstance affects normal venue.

Your question is too general. But I suggest you ask your County Clerk for an answer. Or, ask a lawyer in Illinois.

If the incident occurred in Illinois, the suit is filed in Illinois in the county where the incident occurred.

Establishing residency by living in an area for a certain length of time has nothing to do with whether or not you can file a lawsuit for wrongful death in Illinois. Establishing residency is only for aspects that provide certain benefits to, or restrictions on, citizens of a particular state, ie: the right to vote in that area, the right to marry or divorce, apply for state benefits such as SSI, pay in-state tuition vs out-of-state tuition, etc.

The only time limit for which you need to be concerned is the statute of limitations as it applies to medmal complaints. I found the following information by doing a web search for 'statute of limitations, Illinois'.

Statute Of Limitations Applicable to Medical Malpractice Cases Filed in Illinois.

In Illinois, a lawsuit for medical malpractice must generally be filed within two years from the date the victim knew, or should have known of the malpractice. However, all medical malpractice actions must be brought no later than four years from the date on which the medical malpractice occurred, even if the victim of the malpractice was unaware of the malpractice until more than four years later. If the victim of the malpractice is a minor, the statute of limitations is generally longer.
