| My sister went into the hospital for elective surgery to have a syst removed from her uterus. During the proceedure an irrigation tool was used in conjunction with a fluid to extract the syst. Somehow the amount of "fluid" administered was too much, and filled in her lungs. She was given medication to counteract this "fluid", the medication sent her into cardiac arrest, for some reason she was without oxygen to the brain for this period, we were told later anywhere from 7 to 12 minutes. This resulted in brain death. The autopsy confirmed this "fluid" overdose was the cause that precipitated her eventual death. She died at the age of 37. My brother-in-law has retained council, my question is do I or my other siblings have any legal recourse in this matter, and if so what would they be. This took place in upstate New York, which is where I live. |
