wrongful death S.W. MI . my mother was in a nursing home for 2 yrs and had emphyzema COPD , was not oxegen dependant at time of death ,She complained of trouble breathing on fri the 8th , I was not notified , they didnt call her doctor till the 10th . he did not see her and prescribed a breathing treatment over the phone. I visited her on the evening of the 10th , she was gasping for air and had a blueish color ,I had the home call the ambulance, the EMTs found her pulse-ox to be 67 (92-100 is normal) they took her to the hospitial and she was admitted and treated for pnumonia,dehydration, she died on the 11th , Its comon knoledge to give copd patients antibiotics at the first sign of breathing trouble because it can rapidly develope into pnumonia, The doctor at the hospital told me at the time of admitance that she had pnumonia and wouldnt make it, the nurse also said that the second chest Xray lookoed different than the first one because she was so dehydrated that nothing showed up on the first one. when my wife and I returned to the nursing home to clean out her room the nurse there said she had informed the staff to keep a close eye on her because of her breathing, The home did not make any nurses notes for the 8th or 9th so there is just the nurses word that she complained of trouble breathing on the 8th, the hospital didnt list pnumonia on the death summery, but the doctor told me several times she had pnumonia and showed me lab work that indicated pnumonia also . when I take the file to have a lawer look at it they speed read the death summery and hand it back and say there is nothing they can do . If I take it to a lawer who has a medical background they seem to think its a good case but not enough money in it for them and they try to hand it off to someone who cant do anything with it, in Mi we have caps on nursing home law suits and unless its a slam dunk kind of case no one who is capable wants it. Sugestions, thanks
