Question

wrongful death negotiation while still alive


What is the name of your state? CA.
I've been told by a few attorney's that its possible to negotiate a wrongful death claim now before I die so that I may care for my children and medical needs. I am currently awaiting a heart transplant due to medical malpractice. I was in a clinical trail for Hep C virus and the hospital and drug company failed to monitor my condition resulting in conjestive heart failure. I have been awaiting a transplant for almost 2 years and have a cardiac defibilator implanted to keep me alive. I have now been informed by my doctors that heart transplant patients with Hep C have a very low survival rate, mostly living for about 1-2 years. My lawyer who settled the first claim neglected to get my medical needs met since I had Medicare, but Medicare only covers the surgery, not the meds I require to stay alive . Any advice would be helpful. Thank you.

Robert, file the med-mal claim now and name your children on the law suit also. if or when you die your children can then carry on the suit.
